Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Dial mobile application ("App") provided by Dial Labs LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Dial is a screen time management application that helps users reduce phone usage and improve digital wellbeing by:

  • Blocking access to selected applications during user-defined restriction periods
  • Tracking screen time usage and providing analytics
  • Implementing "Strict Mode" sessions that enforce app blocking

2.1 Strict Mode

Dial offers two levels of Strict Mode:

  • Strict Mode: You cannot disable app restrictions during an active session through the App except by paying $0.39 to unlock.
  • Ultra Strict Mode: You cannot pay to unlock. You receive 2 emergency bypasses per month. Otherwise, you must wait for the session to end.

Circumvention Methods: While Dial uses Apple's Screen Time API to enforce blocking, the App does not and cannot fully prevent all methods of circumvention. You may bypass blocking at any time by deleting the Dial app from your device or by disabling Screen Time permissions in iOS Settings. Dial is designed to add friction and help you build better habits—not to create an inescapable restriction. By using Strict Mode, you acknowledge that the effectiveness of blocking depends on your own commitment.

2.2 Subscriptions

Dial offers a free tier with core app blocking features. Advanced features, including Dial Down alarms, are available through a Pro subscription. Subscription pricing and terms are available in the Apple App Store. Subscriptions are managed through Apple and subject to Apple's subscription terms.

2.3 Dial Down (Patent-Pending)

Dial Down is an automated sleep hygiene feature that combines scheduled app blocking with wake-up alarms. The Dial Down system and related technology are patent-pending. All times within Dial Down (wind-down notification, blocking start, bedtime, alarm, and morning unblock) are fully configurable by the user.

2.4 Alarms and Notifications

Dial includes alarm and notification features as part of the Dial Down functionality. You acknowledge and agree that Dial Labs LLC is not liable for any alarms or notifications that fail to fire, are delayed, or are otherwise not delivered. Alarm delivery depends on iOS system conditions, device settings (including Do Not Disturb, Focus modes, and notification permissions), battery status, app termination by iOS, and other factors outside our control.

You should always maintain a backup alarm for critical wake-up times. Dial alarms are provided as a convenience feature and should not be relied upon as your sole method of waking up for important events, work, travel, or any time-sensitive obligations.

3. In-App Purchases

3.1 Unlock Purchase

During an active Strict Mode restriction session (not Ultra Strict), you may purchase an unlock for $0.39 USD to immediately exit and restore access to blocked applications. This is a consumable in-app purchase that:

  • Is consumed immediately upon successful purchase
  • Ends the current restriction session
  • Does not provide ongoing benefits or subscription access
  • Must be purchased again for each instance you wish to exit Strict Mode early

Note: Ultra Strict Mode does not allow paid unlocks. You may only use your 2 monthly emergency bypasses or wait for the session to end.

3.2 No Refunds

All Undial purchases are final and non-refundable. Because the Undial purchase is a consumable item that provides immediate benefit (ending your restriction session), refunds will not be issued under any circumstances, including but not limited to:

  • Accidental purchases
  • Change of mind after purchase
  • Technical issues occurring after the restriction session has been ended
  • Dissatisfaction with the service

By purchasing an Undial pass, you acknowledge that you have read and agree to this no-refund policy.

3.3 Payment Processing

All in-app purchases are processed through the Apple App Store. Your purchase will be charged to your Apple ID account. Pricing may vary by region and is subject to change without notice.

4. User Accounts and Authentication

4.1 Account Creation

To use the App, you must create an account by providing a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4.2 Accurate Information

You agree to provide accurate, current, and complete information during onboarding and account creation, including demographic information such as name, birthdate, gender, occupation, and baseline usage data.

5. Use of iOS ScreenTime API

The App utilizes Apple's ScreenTime API (FamilyControls, ManagedSettings, and DeviceActivity frameworks) to:

  • Monitor your app usage
  • Apply restrictions to selected applications
  • Generate usage reports and analytics

By using the App, you grant permission for the App to access and utilize these iOS system features. You acknowledge that these restrictions are enforced at the operating system level and cannot be bypassed during an active Strict Mode session except through the Undial purchase mechanism.

6. Acceptable Use

You agree NOT to:

  • Attempt to circumvent, disable, or interfere with the App's restriction features
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose
  • Share your account credentials with others
  • Use automated systems or scripts to interact with the App
  • Attempt to gain unauthorized access to the App's systems or infrastructure

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of screen time data or analytics

You acknowledge that the App is a tool to assist with digital wellbeing but does not guarantee any specific outcomes regarding behavior change, productivity, or mental health.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Dial Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App
  • Our total liability to you for all claims arising from your use of the App shall not exceed the amount you have paid us in the past twelve (12) months, or $10.00 USD, whichever is greater
  • We are not liable for any damages resulting from your inability to access blocked applications during a restriction session, including emergency situations
  • We are not liable for any damages, losses, or consequences resulting from alarms or notifications that fail to fire, are delayed, or are not delivered for any reason, including but not limited to missed appointments, missed work, travel delays, or any other time-sensitive events

You assume full responsibility for the consequences of enabling Strict Mode and blocking access to applications. In emergency situations, you may use the unlock purchase (Strict Mode) or emergency bypass (Ultra Strict Mode) to restore access. You also assume full responsibility for relying on Dial alarms and should always maintain backup alarms for critical wake-up times.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dial Labs LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Data Collection and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data collection and processing practices described in our Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting an updated version within the App
  • Sending an email to your registered email address
  • Displaying a notification when you next open the App

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Deleting the App from your device
  • Contacting us at team@sleepdial.com to request account deletion

12.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • Any other reason at our sole discretion

12.3 Effects of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • We may delete your account data in accordance with our Privacy Policy
  • Any outstanding Undial purchases are forfeited without refund

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall take place in Essex County, New Jersey.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dial Labs LLC regarding the App and supersede all prior agreements and understandings.
